INTRODUCTION

The SportfitTM interactive program (the “Program”) is operated by 2010 Legacies Now Society (“LNS”). As part of the Program personal information about individuals (usually, students) and their instructors will be provided to LNS by a school, camp or similar organization (the “Organization”). This document will briefly summarize the commitment of LNS to such Organizations and registering individuals concerning the collection, use and disclosure of that information by LNS in operating the Program.

PRIVACY OF CHILDREN

The safety of children online is of special importance to LNS. LNS recommends that parents preview our site before letting children use it, and supervise the use of this site by children. Use of this site by children under the age of majority is subject to parental or legal guardians’ consent, and such consent is implied for all students in the British Columbia school system. Parents should supervise their children’s use of this and any other site, including responses to requests for information. LNS attempts to ensure that all content on this site is suitable for younger children. LNS will not contact users of this site for marketing or promotional purposes.

PASSWORDS AND USERNAMES

Users are responsible for keeping their passwords and usernames secret, and LNS is not liable for any damages or injuries resulting from the unauthorized interception, collection and misuse of personal information by persons, organizations or government agencies. When an individual is finished using this site, they should close their Web browser window before leaving their computer unattended, especially if accessing this site from a school or other public computer. This is so that no one else can use the browser with LNS’s site with the individual’s user information still active.

INFORMATION COLLECTED

Under the Program, four types of information collected about individuals:
(1) Identifier Information (individual name and Challenge Session number)
(2) Demographic Information (birthdate, gender, province of residence, country of residence)
(3) Questionnaire Information (individual sports preferences and pre-dispositions)
(4) Sportfit Individual Test Results (on completion of the Program).

MANNER OF COLLECTION

Some information is input directly into the Program by participating individuals, under the control and supervision of the Organization. Other information, including Test Results, may be input by instructors. Each individual and instructor has a separate password regulating their Program access. LNS regards all such information as being communicated to it by or on behalf of the Organization, and looks to the Organization to ensure that all applicable laws, including privacy laws, are complied with and that all necessary consents are obtained relating to the circumstances of disclosure of this information to LNS. All information is collected and stored in accordance with the requirements of the Schools Act (B.C.).
There are a variety of ways information is collected on this site. The Program computer server which handles traffic to and from the site records the Internet Protocol (IP) address of the computer from which an individual accessed the Program, and records which parts of the Program site are visited in each session. This may identify the Internet Service Provider (ISP) from which a communication with the site originated. The server log information is not used to personally identify a visitor, only the flow of traffic through the site.

USE OF INFORMATION

1. Identifier Information is collected and used by LNS:
(a) to operate the Program, including communicating with registrants;
(b) to permit the individual and instructor to link to and view their own information and test results, both current and historical;
(c) to generate a Program completion certificate for delivery to the individual.
Identifier Information is not used for any other purpose in the Program and is not used by LNS for any other programs or activities of LNS, or for contacting individuals about other LNS initiatives.
2. Demographic Information, Questionnaire Information and Test Results will be used by LNS:
(a) to report results to the relevant individual on their official certificate; and
(b) to be accessed by individuals and their instructors through the interactive online Program utilizing password access rights.
3. Demographic Information, Questionnaire Information and Test Results may be aggregated and used by LNS in anonymized statistical form (without linkage to Identifier Information) for the purpose of reviewing and analyzing participation in the Program, sports preferences and test performances.
4. No other use will be made of Demographic Information, Questionnaire Information or Test Results.

INSTRUCTORS

When registering for the Program as an instructor and on behalf of the Organization, that person will be asked for their name, a valid teacher identification number, current home address and telephone number, current school’s address, telephone and fax number, and an email address (confirmation email will be sent there). LNS will confirm the validity of the teacher identification number, and if the number cannot be verified, access to the Program will be denied. LNS will not release this personal data to any third party, except that the teacher identification number provided to LNS will be sent to the British Columbia Teacher’s College for verification as a valid number.

DISCLOSURE

All Information about an individual is available to and disclosed to that individual through use of their registration and password.
All information about an instructor’s individuals (students) participating in the Program through a Challenge Session Number is disclosed to and available to that instructor through use of the instructor’s registration and password.
All information about individuals (students) participating in the Program at a particular Organization is disclosed to and available to the head of that Organization through use of the Organization’s registration and password.
LNS may disclose and publish anonymized statistical information containing Demographic Information, Questionnaire Information and Test Results to other organizations, governments, public bodies or the public at large to support study and analysis of Program participation, sports preferences and Program test results.
LNS may also disclose information as required or permitted by applicable law, including the Personal Information Protection Act (B.C.).

CONSENT

By registering and participating in the Program for a challenge session through an instructor, the Organization is representing to LNS that all necessary consents and agreements are in place for the collection, use and disclosure of information as outlined in this Privacy Statement. LNS shall not make any use or disclosure of personal information other than as outlined above without the consent of the Organization, except as required or permitted by applicable law.
In order for the Program to work, a minimum amount of personal data must be collected from an individual. Without such personal data, an individual could still access the information portions of the SportfitTM website, but will not be able to participate in the Program or a challenge session.

SAFEGUARDING AND SECURITY

LNS maintains appropriate safeguards and security measures designed to protect personal information in its custody and control collected under the Program against unauthorized access, disclosure or misuse. Information which comes in the custody of individuals, instructors and Organizations by virtue of their access rights to the Program data will be subject to such laws, rules and procedures applicable to those persons and Organizations. LNS has no responsibility for or control over such other laws, rules or procedures.

ACCURACY

LNS makes reasonable efforts to maintain the integrity of information collected under the Program. Organizations, through individuals and instructors, are responsible for correcting errors in such data and may do so through their registration access rights.

RETENTION AND DESTRUCTION

LNS will normally retain Program data in personalized form for a period of 10 years to enable continued access and reference by registered individuals. After such time, LNS shall delete Identifier Information and cancel user account rights. LNS reserves the right to terminate user accounts and delete any information on a user account which has been inactive for over 7 years.
LNS may retain Program data in anonymized form (omitting Identifying Information) for such longer periods as LNS may consider reasonably necessary for continue analysis and evaluation of the Program and its results.
Destruction of information will be conducted in accordance with reasonable industry standards.

ACCESS

Individuals may access their own information online utilizing their registration and password. Access will also be provided, if requested, in accordance with applicable law.
